Welcome to Made for MeiMei. These Terms of Service (“Terms”) govern your use of the Made for MeiMei website, online store, and related services (collectively, the “Site”).

The Site is operated by Made for Meimei LLC, doing business as Made for MeiMei (“Made for MeiMei,” “we,” “us,” or “our”).

By accessing our Site, placing an order, registering for a workshop or event, or otherwise using our services, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.

1. Our Products

Made for MeiMei produces and sells food products, including mochi and related products.

We do our best to accurately display product descriptions, ingredients, photographs, colors, nutritional information, availability, and other information on our Site. Because our products are food products made in batches, slight variations in appearance, color, texture, size, or other characteristics may occur.

Recipes, ingredients, packaging, and product availability may also change from time to time. Please always review the ingredient and allergen information on the product packaging you receive before consuming the product.

2. Food Allergies and Dietary Information

We take food allergies seriously and provide ingredient and allergen information to help customers make informed decisions.

Certain Made for MeiMei products may contain or use ingredients including peanuts, tree nuts, sesame, and coconut, depending on the flavor or product.

Unless expressly stated otherwise, we cannot guarantee that a product is completely free from cross-contact with allergens.

Our products may be made using ingredients that do not contain gluten; however, Made for MeiMei is not a certified gluten-free facility or certified gluten-free brand unless a specific product is expressly identified as such.

If you have a severe food allergy, sensitivity, or dietary restriction, please review the product label carefully and contact us with questions before consuming our products.

3. Product Storage and Food Safety

Made for MeiMei products are perishable and should be stored and handled according to the instructions provided on their packaging.

Depending on the product, this may include refrigerated or frozen storage.

Customers are responsible for promptly receiving delivered products and following the applicable storage instructions after delivery.

If a package arrives damaged, unusually warm, compromised, or in a condition that causes you to question whether the product is safe to eat, please do not consume the product and contact us as soon as possible.

4. Orders

Submitting an order through our Site is an offer to purchase the selected products. We reserve the right to accept, decline, or cancel an order when reasonably necessary, including because of:

• product unavailability;

• an incorrect price or product description;

• suspected fraud or unauthorized payment;

• shipping or delivery limitations;

• an error affecting the order; or

• circumstances that prevent us from safely fulfilling the order.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

Products are subject to availability, and placing an item in your cart does not guarantee availability until your order has been accepted.

5. Pricing and Payment

Prices are shown in U.S. dollars unless otherwise stated.

Applicable government-imposed taxes and reasonable shipping charges may be calculated separately where permitted. Any other mandatory charges applicable to a purchase will be disclosed as part of the price as required by applicable law.

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize us and our payment service providers to charge the amount associated with your purchase.

We may change our prices at any time. Price changes will not affect orders that we have already accepted except where correction of an obvious error is permitted by law.

6. Shipping and Delivery

Because many Made for MeiMei products are perishable, we may use insulated packaging, ice packs, expedited shipping, or other measures intended to maintain product quality during transit.

Shipping rates and available shipping methods will be displayed during checkout when applicable.

Any shipping or delivery dates shown on our Site are estimates unless expressly stated otherwise. We will make reasonable efforts to fulfill orders within the timeframe communicated to you.

Weather, carrier disruptions, incorrect addresses, inaccessible delivery locations, and other circumstances outside our reasonable control may affect delivery.

Please make sure your shipping information is complete and accurate before placing an order. Contact us as soon as possible if you discover an error. We cannot guarantee that an address can be changed after an order has entered fulfillment.

Because our products are perishable, we strongly recommend retrieving your package promptly after delivery.

7. Problems With an Order and Satisfaction Guarantee

We want you to be happy with your Made for MeiMei order.

If your order arrives damaged, incorrect, compromised in transit, or otherwise does not meet your expectations, please contact us within seven (7) days of delivery.

When contacting us, we may ask for your order number, photographs, or other information that helps us understand and resolve the issue.

Depending on the circumstances, available remedies may include a replacement, refund, store credit, or another appropriate resolution under our current satisfaction and refund policies.

Because we sell perishable food, we generally cannot accept physical returns of food products unless we specifically request a return.

Nothing in these Terms limits any refund, replacement, or other remedy that you are entitled to under applicable law.

8. Workshops, Classes, Pop-Ups, and Events

From time to time, Made for MeiMei may offer workshops, classes, pop-ups, collaborations, or other in-person experiences.

Event dates, times, locations, cancellation policies, age requirements, and other event-specific terms will be provided on the applicable registration or event page. Event-specific terms will control if they conflict with these general Terms.

Participants are responsible for informing us of relevant food allergies or dietary concerns before participating in food-related activities.

Children may participate in events identified as child-friendly when accompanied or supervised as required by the applicable event rules.

Certain events may require a separate waiver, release, or participation agreement.

9. Cancellations and Event Refunds

Workshop and event registrations are subject to the cancellation or refund policy displayed when you register.

Because workshops may have limited capacity and require us to purchase ingredients and prepare materials in advance, cancellation deadlines may apply.

If Made for MeiMei cancels an event, registered participants will receive the applicable refund, rescheduling option, credit, or other remedy communicated for that event.

10. Promotions, Discount Codes, and Gift Offers

From time to time, we may offer discounts, promotional codes, giveaways, special offers, or other promotions.

Unless otherwise stated:

• promotions are available for a limited time;

• promotional codes have no cash value;

• discounts cannot be applied retroactively to completed purchases;

• promotions may be limited to certain products, quantities, customers, locations, or order values; and

• multiple promotions may not be combined.

Additional terms provided with a particular promotion will apply to that promotion.

We reserve the right to refuse or cancel the use of a promotion when we reasonably believe it is being used fraudulently, abusively, or contrary to its stated terms.

11. Nutrition and Wellness Information

Information provided on our Site regarding nutrition, ingredients, protein, fiber, sugar, dietary characteristics, or similar subjects is intended to provide information about our products.

Our Site does not provide medical or nutritional advice and is not a substitute for advice from a physician, registered dietitian, or other qualified healthcare professional.

Individual dietary and nutritional needs vary.

12. Acceptable Use of Our Site

You agree not to use the Site:

• for unlawful or fraudulent purposes;

• to interfere with the operation or security of the Site;

• to attempt to gain unauthorized access to our systems or another person's information;

• to transmit malicious code, viruses, or similar technology;

• to scrape, copy, reproduce, or commercially exploit Site content without authorization; or

• in any manner that violates the rights of Made for MeiMei or another person.

We may restrict or terminate access to the Site when we reasonably believe these Terms have been violated.

13. Intellectual Property

The Made for MeiMei name, branding, logos, packaging designs, graphics, photographs, videos, written content, product names, recipes and other original materials appearing on the Site are owned by or licensed to Made for Meimei LLC, except where otherwise indicated.

Nothing in these Terms grants you ownership of or a license to use our intellectual property except for the limited right to access the Site for your personal, noncommercial use.

You may not reproduce, modify, distribute, sell, imitate, publish, or commercially use our protected content without our prior written permission.

14. Third-Party Services and Links

Our Site may use or link to services operated by third parties, including payment processors, shipping carriers, social media platforms, mapping services, or other websites.

Those third parties may have their own terms and privacy policies. Made for MeiMei is not responsible for the content or practices of third-party websites or services that we do not control.

15. Privacy

Your use of our Site is also subject to our Privacy Policy, which describes how we collect, use, and protect personal information.

16. Website Availability and Disclaimers

We work to keep our Site accurate and available, but we cannot guarantee that it will always be uninterrupted, error-free, or completely current.

To the fullest extent permitted by applicable law, the Site and its content are provided on an “as available” basis.

Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded under applicable consumer protection law.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Made for Meimei LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from your use of or inability to use the Site.

This limitation does not apply where liability cannot legally be limited or excluded, including any rights or remedies available to you under applicable consumer protection laws.

18. Indemnification

To the extent permitted by law, you agree to be responsible for losses or claims arising from your unlawful misuse of the Site or your material violation of these Terms.

This provision does not require you to indemnify Made for MeiMei for conduct for which indemnification may not lawfully be required.

19. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute that is properly brought in court will be subject to the jurisdiction and venue provided by applicable law. Where legally permissible, the parties agree that proceedings may be brought in the state or federal courts serving San Diego County, California.

Nothing in this section deprives a consumer of protections or rights that cannot be waived under applicable law.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, services, business practices, or applicable requirements.

When we make changes, we will update the “Last Updated” date at the top of this page. Material changes will apply prospectively as required by applicable law.

Your continued use of the Site after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

21. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

22. Entire Agreement

These Terms, together with any policies or terms expressly incorporated into them, constitute the agreement between you and Made for MeiMei regarding your use of the Site.

Product-specific, promotion-specific, or event-specific terms may supplement these Terms.
